Recent Developments
Administrative fines are increased and applied annually in accordance with Article 17(7) of the Misdemeanors Law No. 5326 (“Misdemeanors Law”), based on the revaluation rate determined and announced by the Ministry of Treasury and Finance pursuant to repeated Article 298 of the Tax Procedure Law No. 213 (“TPL”). Indeed, the lower and upper limits of the administrative fines stipulated under the Law No. 6698 on Personal Data Protection (“DPL”) are also redetermined at the beginning of each calendar year by increasing them at the revaluation rate for the relevant year.
In this regard, the Turkish Data Protection Authority (“Authority”) has published the updated administrative fines stipulated under the DPL on its website, effective as of 1 January 2026. Accordingly, the administrative fines have increased by 25.49%.
