Bu kapsamda, siber olaylar\u0131n muhtemel etkilerini azaltmaya y\u00f6nelik esaslar\u0131n belirlenmesi, kurum ve kurulu\u015flar\u0131n siber sald\u0131r\u0131lara kar\u015f\u0131 korunmas\u0131na y\u00f6nelik d\u00fczenlemelerin yap\u0131lmas\u0131 ve T\u00fcrkiye\u2019nin siber g\u00fcvenli\u011fini g\u00fc\u00e7lendirmek i\u00e7in strateji ve politikalar\u0131n belirlenmesi amac\u0131yla yasama faaliyetleri y\u00fcr\u00fct\u00fclm\u00fc\u015f ve Siber G\u00fcvenlik Kanunu Teklifi (\u201c<strong>Kanun Teklifi<\/strong>\u201d), 10 Ocak 2025 tarihinde T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi\u2019ne sunulmu\u015ftu. S\u00f6z konusu Kanun Teklifi, 12 Mart 2025 tarihinde T\u00fcrkiye B\u00fcy\u00fck Meclisi taraf\u0131ndan onayland\u0131 ve 19 Mart 2025 tarihli ve 32846 say\u0131l\u0131 Resmi Gazete\u2019de yay\u0131mlanarak y\u00fcr\u00fcrl\u00fc\u011fe girdi.<\/p>\n<p>Siber G\u00fcvenlik Kanunu\u2019na (\u201c<strong>Kanun<\/strong>\u201d) <a href=\"https:\/\/urldefense.com\/v3\/__https:\/esinxchange.com\/collect\/click.aspx?u=K2ZTeFh2NHVUdmtzTlA4UFhVN29EcHlQSjROdzVIcDlrV2FLeXJzR3RvUndiSWhnMFB4amFJWnREdXFIR0kwUmNVYWwwOGo5aXFLaGVNZ2dkSHNQWVpTVjdLTmNXS0IxVE5lS0psNXRQVDRadTJRdlBQOS8zMUxxQUNOZkdCb0U=&amp;rh=ff00e45c865cf02c928ef0782f489a6a7b2f67d7__;!!Hj9Y_P0nvg!Q-b9K8qL7AwLSvG7uJ4Py-G7y1TB6apJI4oRzhTGXd69x4deI293NrkhWwVr9fi36gWZMWjytGbqiXgAvypTvdIQug$\">buradan<\/a> ula\u015fabilirsiniz.<\/p>\n<p><strong>Kanun Kimleri Kaps\u0131yor<\/strong><\/p>\n<p>Kanun\u2019da yer alan d\u00fczenlemeler, siber uzayda varl\u0131k g\u00f6steren, faaliyet y\u00fcr\u00fcten, hizmet sunan (i) kamu kurum ve kurulu\u015flar\u0131n\u0131, (ii) kamu kurumu niteli\u011finde meslek kurulu\u015flar\u0131n\u0131, (iii) ger\u00e7ek ve t\u00fczel ki\u015fileri ve (iv) t\u00fczel ki\u015fili\u011fi bulunmayan kurulu\u015flar\u0131 kapsamaktad\u0131r. Kanun uyar\u0131nca, \u201csiber uzay\u201d kavram\u0131; do\u011frudan ya da dolayl\u0131 olarak internete, elektronik haberle\u015fme veya bilgisayar a\u011flar\u0131na ba\u011fl\u0131 olan t\u00fcm bile\u015fim sistemleri ve bunlar\u0131 birbirine ba\u011flayan a\u011flardan olu\u015fan ortamlar\u0131 ifade etmektedir. Bu anlamda, Kanun\u2019da yer alan d\u00fczenlemelerin geni\u015f bir akt\u00f6r yelpazesini kapsad\u0131\u011f\u0131 de\u011ferlendirildi\u011finde, Kanun\u2019un siber g\u00fcvenlik ekosisteminde kapsaml\u0131 bir etki alan\u0131na sahip olmas\u0131 beklenmektedir.<\/p>\n<p><strong>Kanun Neler Getiriyor<\/strong><\/p>\n<ul>\n<li><em><u>Siber G\u00fcvenlik Ba\u015fkanl\u0131\u011f\u0131<\/u><\/em>. Kanun, 8 Ocak 2025 tarihli ve 32776 say\u0131l\u0131 Resmi Gazete\u2019de yay\u0131mlanan 177 numaral\u0131 Siber G\u00fcvenlik Ba\u015fkanl\u0131\u011f\u0131 Hakk\u0131nda Cumhurba\u015fkan\u0131 Kararnamesi ile kurulan Siber G\u00fcvenlik Ba\u015fkanl\u0131\u011f\u0131\u2019n\u0131n (\u201c<strong>Ba\u015fkanl\u0131k<\/strong>\u201d) g\u00f6revlerine yer vermektedir. Buna g\u00f6re, Ba\u015fkanl\u0131k\u2019\u0131n; (i) kritik altyap\u0131lar ve bili\u015fim sistemlerinin siber dayan\u0131kl\u0131l\u0131\u011f\u0131n\u0131n art\u0131r\u0131lmas\u0131 ad\u0131na \u00e7al\u0131\u015fmalar y\u00fcr\u00fctmek, ve bu kapsamda s\u0131zma testleri, zafiyet testleri ve varl\u0131klara y\u00f6nelik risk analizi yapmak, siber tehditlerle m\u00fccadele etmek, (ii) kritik altyap\u0131lar ile ait olduklar\u0131 kurumlar\u0131 ve konumlar\u0131 belirlemek, (iii), kamu kurum ve kurulu\u015flar\u0131 ile kritik altyap\u0131lar\u0131n veri envanteri d\u00e2hil olmak \u00fczere t\u00fcm varl\u0131klar\u0131n\u0131n envanterinin tutulmas\u0131n\u0131 ve varl\u0131klara y\u00f6nelik risk analizinin ger\u00e7ekle\u015ftirilmesini sa\u011flamak ve bu varl\u0131klar\u0131n kritikli\u011fine g\u00f6re g\u00fcvenlik tedbirleri sa\u011flamak, (iv) mevzuat \u00e7al\u0131\u015fmalar\u0131 y\u00fcr\u00fctmek, (v) siber g\u00fcvenlik faaliyetlerinde koordinasyonu sa\u011flamak, (vi) acil durum planlar\u0131 haz\u0131rlamak, (vii) yaz\u0131l\u0131m, donan\u0131m, \u00fcr\u00fcn, sistem ve hizmetlere y\u00f6nelik test ve sertifikasyon i\u015flemlerini y\u00fcr\u00fctmek, (viii) siber g\u00fcvenlik alan\u0131nda Ar-Ge ve teknoloji faaliyetleri y\u00fcr\u00fctmek ve (ix) siber g\u00fcvenlik \u00fcr\u00fcnlerinin ve bu \u00fcr\u00fcnleri \u00fcreten \u015firketleri sat\u0131\u015f\u0131na ili\u015fkin bilgi ve belge talep etmek gibi \u00e7e\u015fitli g\u00f6revleri bulunmaktad\u0131r.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li><em><u>Siber G\u00fcvenlik Kurulu<\/u><\/em>. Kanun ile beraber, Cumhurba\u015fkan\u0131, Cumhurba\u015fkan\u0131 Yard\u0131mc\u0131s\u0131, Siber G\u00fcvenlik Ba\u015fkan\u0131 ve \u00e7e\u015fitli bakanlar ile kamu kurulu\u015flar\u0131 ba\u015fkanlar\u0131n\u0131n yer ald\u0131\u011f\u0131 Siber G\u00fcvenlik Kurulu (\u201c<strong>Kurul<\/strong>\u201d) kurulmu\u015ftur. Kurul\u2019un ba\u015fl\u0131ca g\u00f6revleri aras\u0131nda; (i) siber g\u00fcvenlikle ilgili eylem plan\u0131, politika gibi d\u00fczenleyici i\u015flemlere y\u00f6nelik karar almak, (ii) Ba\u015fkanl\u0131k taraf\u0131ndan haz\u0131rlanan siber g\u00fcvenli\u011fe ili\u015fkin teknoloji yol haritas\u0131n\u0131n uygulanmas\u0131na y\u00f6nelik karar almak, (iii) kritik altyap\u0131 sekt\u00f6rlerini belirlemek ve (iv) Ba\u015fkanl\u0131k ile kamu kurum ve kurulu\u015flar\u0131 aras\u0131nda meydana gelebilecek ihtilaflar hakk\u0131nda karar almak yer almaktad\u0131r.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li><em><u>Bili\u015fim Sistemleri Kullanmak Suretiyle Hizmet Sunan, Veri Toplayan, \u0130\u015feyen ve Benzeri Faaliyet Y\u00fcr\u00fctenler<\/u><\/em>. Kanun\u2019da, bili\u015fim sistemlerini kullanarak hizmet sunan, veri toplayan ve i\u015fleyenlerin siber g\u00fcvenli\u011fe ili\u015fkin g\u00f6rev ve sorumluluklar\u0131 da d\u00fczenlenmektedir. Buna g\u00f6re, s\u00f6z konusu ger\u00e7ek ve\/veya t\u00fczel ki\u015filer; (i) Ba\u015fkanl\u0131k taraf\u0131ndan talep edilen bilgi ve belgeleri sunmakla, (ii) mevzuat kapsam\u0131nda \u00f6ng\u00f6r\u00fclen tedbirleri almak ve hizmet sunduklar\u0131 alanda tespit ettikleri zafiyetleri veya siber olaylar\u0131 gecikmeksizin Ba\u015fkanl\u0131k\u2019a bildirmekle, (iii) kritik altyap\u0131larda kullan\u0131lacak siber g\u00fcvenlik \u00fcr\u00fcn, sistem ve hizmetlerini Ba\u015fkanl\u0131k taraf\u0131ndan yetkilendirilmi\u015f ve sertifikaland\u0131r\u0131lm\u0131\u015f siber g\u00fcvenlik uzmanlar\u0131ndan ve \u015firketlerinden tedarik etmekle, (iv) sertifikasyon, belgelendirme veya yetkilendirmeye tabi siber g\u00fcvenlik \u015firketlerince faaliyete ba\u015flamadan \u00f6nce mevcut d\u00fczenlemeler \u00e7er\u00e7evesinde Ba\u015fkanl\u0131k onay\u0131n\u0131 almakla, (v) Ba\u015fkanl\u0131k taraf\u0131ndan belirlenen politika, strateji ve eylem plan\u0131 gibi belgelerde yer alan gereklilikleri yerine getirmekle ve (vi) Ba\u015fkanl\u0131k taraf\u0131ndan yay\u0131mlanan tavsiye ve benzeri belgelere uyum sa\u011flamakla y\u00fck\u00fcml\u00fcd\u00fcr.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li><em><u>Denetim<\/u><\/em>. Kanun ayr\u0131ca, Ba\u015fkanl\u0131k\u2019\u0131n g\u00f6revleri ile ilgili olarak gerekli g\u00f6rd\u00fc\u011f\u00fc hallerde Kanun\u2019un kapsam\u0131na giren her t\u00fcrl\u00fc fiil ve i\u015flemi denetleyebilece\u011fini, bu ama\u00e7la mahallinde inceleme yapabilece\u011fini veya yapt\u0131rabilece\u011fini d\u00fczenlemektedir. S\u00f6z konusu denetim faaliyetleri, Ba\u015fkanl\u0131k taraf\u0131ndan belirlenecek \u00f6nemlilik ve \u00f6ncelik ilkeleri ile risk de\u011ferlendirmeleri kapsam\u0131nda olu\u015fturulacak program uyar\u0131nca y\u00fcr\u00fct\u00fclecek olmakla beraber, Ba\u015fkanl\u0131k\u2019\u0131n gerekli g\u00f6rmesi halinde program d\u0131\u015f\u0131 denetim yap\u0131lmas\u0131 da m\u00fcmk\u00fcnd\u00fcr. Kanun\u2019da, milli g\u00fcvenlik, kamu d\u00fczeni, su\u00e7 i\u015flenmesinin veya siber sald\u0131r\u0131lar\u0131n \u00f6nlenmesi amac\u0131yla hakim karar\u0131 \u00fczerine veya gecikmesinde sak\u0131nca bulunan hallerde Cumhuriyet savc\u0131s\u0131n\u0131n yaz\u0131l\u0131 emri ile konutta, i\u015fyerinde, ve kamuya a\u00e7\u0131k olmayan kapal\u0131 alanlarda arama yap\u0131labilece\u011fi d\u00fczenlenmektedir. Buna g\u00f6re, uzun s\u00fcreli hizmet aksamas\u0131 yaratmamas\u0131 \u015fart\u0131yla s\u00f6z konusu durumlarda kopya \u00e7\u0131kar\u0131lmas\u0131 ve el koyma i\u015flemi ger\u00e7ekle\u015ftirilmesi de m\u00fcmk\u00fcnd\u00fcr. Bununla beraber, yetkilendirilmi\u015f veri merkezi i\u015fletmecilerinin veri merkezlerinde yaln\u0131zca hakim karar\u0131yla arama, kopya \u00e7\u0131karma ve el koyma i\u015flemi ger\u00e7ekle\u015ftirilebilecektir.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>Kanun uyar\u0131nca, denetime tabi tutulanlar, ilgili cihaz, sistem, yaz\u0131l\u0131m ve donan\u0131mlar\u0131 verilen s\u00fcrelerde denetlemeye a\u00e7\u0131k tutmak, denetim i\u00e7in gerekli altyap\u0131y\u0131 temin etmek ve \u00e7al\u0131\u015f\u0131r vaziyette tutmak i\u00e7in gerekli \u00f6nlemleri almak zorundad\u0131r.<\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><em><u>Kritik Altyap\u0131lar<\/u><\/em>. Kanun, kritik altyap\u0131lar\u0131; i\u015fledi\u011fi bilginin\/verinin gizlili\u011fi, b\u00fct\u00fcnl\u00fc\u011f\u00fc veya eri\u015filebilirli\u011fi bozuldu\u011funda ciddi zararlara yol a\u00e7abilen bili\u015fim sistemi altyap\u0131lar\u0131 olarak tan\u0131mlamaktad\u0131r. Kanun uyar\u0131nca, hem Ba\u015fkanl\u0131k\u2019\u0131n hem de Kurul\u2019un kritik altyap\u0131lara ili\u015fkin g\u00f6rev ve yetkileri bulunmaktad\u0131r. Buna g\u00f6re; (i) Kurul, kritik altyap\u0131 sekt\u00f6rlerini belirlemekle; (ii) Ba\u015fkanl\u0131k ise, kritik altyap\u0131lar ile ait olduklar\u0131 kurumlar\u0131 ve konumlar\u0131 belirlemekle, kritik altyap\u0131lar\u0131n sahip oldu\u011fu varl\u0131klar\u0131n envanterinin tutmas\u0131n\u0131 sa\u011flayarak bu altyap\u0131lar\u0131n sahip oldu\u011fu varl\u0131klar\u0131n kritikli\u011fine g\u00f6re g\u00fcvenlik tedbirleri almas\u0131n\u0131 sa\u011flamakla, kritik altyap\u0131larda kullan\u0131lacak siber g\u00fcvenlik \u00fcr\u00fcn ve hizmetleri ile bu altyap\u0131lar\u0131n sa\u011flamas\u0131 gereken teknik kriterleri ve Ba\u015fkanl\u0131k\u2019a yap\u0131lacak bildirimlere ili\u015fkin usul ve esaslar\u0131 belirlemekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>T\u00fcrk hukukundaki mevcut kurallar \u00e7er\u00e7evesinde, elektronik haberle\u015fme, enerji, su y\u00f6netimi, bankac\u0131l\u0131k ve finans, ula\u015ft\u0131rma ve kritik kamu hizmetleri gibi sekt\u00f6rler, kritik altyap\u0131 olarak kabul edilmektedir. Buna g\u00f6re, mevcut kurallar \u00e7er\u00e7evesinde kabul edilen kritik altyap\u0131 kurumu, Kanun\u2019un yer verdi\u011fi kritik altyap\u0131 tan\u0131m\u0131 ve Kurul\u2019un kritik altyap\u0131 sekt\u00f6rlerini belirleme yetkisi g\u00f6z \u00f6n\u00fcnde bulunduruldu\u011funda, ilerleyen s\u00fcre\u00e7lerde s\u0131n\u0131rlar\u0131 netle\u015fecek olan kritik altyap\u0131 sekt\u00f6rlerinde faaliyet g\u00f6steren \u015firketler Kanun\u2019da yer alan d\u00fczenlemelere tabi olabilecektir.<\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><em><u>Siber G\u00fcvenlik \u00dcr\u00fcnleri ve \u015eirketleri.<\/u><\/em> Siber g\u00fcvenlik \u00fcr\u00fcn, sistem, yaz\u0131l\u0131m, donan\u0131m ve hizmetlerin yurt d\u0131\u015f\u0131na sat\u0131\u015f\u0131 Ba\u015fkanl\u0131k\u2019\u0131n onay\u0131na tabi olacakt\u0131r. Ayr\u0131ca, siber g\u00fcvenlik \u00fcr\u00fcnlerini\/hizmetlerini \u00fcreten \u015firketlerin birle\u015fme, b\u00f6l\u00fcnme, pay devri veya sat\u0131\u015f i\u015flemleri Ba\u015fkanl\u0131k\u2019a bildirilecek, bu i\u015flemler ile ger\u00e7ek veya t\u00fczel ki\u015filere m\u00fcnferiden veya birlikte \u015firket \u00fczerinde herhangi bir kontrol hakk\u0131 veya karar yetkisi sa\u011flan\u0131yorsa Ba\u015fkanl\u0131k\u2019\u0131n onay\u0131 aranacakt\u0131r.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li><em><u>Cezai H\u00fck\u00fcmler ve \u0130dari Para Cezalar\u0131<\/u><\/em>. Siber g\u00fcvenli\u011fe ili\u015fkin cayd\u0131r\u0131c\u0131 yapt\u0131r\u0131m s\u00fcre\u00e7lerinin i\u015fletilmesine y\u00f6nelik olarak Kanun, i\u015flenen fiillerin a\u011f\u0131rl\u0131\u011f\u0131na g\u00f6re bir ayr\u0131ma gitmektedir. Buna g\u00f6re, Kanun\u2019da, siber sald\u0131r\u0131 ger\u00e7ekle\u015ftirilmesi, ki\u015fisel veya kurumsal verilerin s\u0131zd\u0131r\u0131lmas\u0131, s\u0131zd\u0131r\u0131lan verilen yay\u0131lmas\u0131 vb. gibi baz\u0131 fiillere hapis cezas\u0131; mevzuat\u0131n \u00f6ng\u00f6rd\u00fc\u011f\u00fc tedbirlerin al\u0131nmamas\u0131 ve denetim faaliyetlerinin engellenmesi gibi di\u011fer baz\u0131 fiiller bak\u0131m\u0131ndan ise idari para cezas\u0131 \u00f6ng\u00f6r\u00fclmektedir.
