H\u00fck\u00fcmet ve \u015firketler salg\u0131na kar\u015f\u0131 verilen m\u00fccadelede \u00e7e\u015fitli \u00f6nlemler al\u0131yor.<\/p>\n<p>\u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131&#8217;n\u0131n 16 Mart 2020 tarihinde il valiliklerine g\u00f6nderdi\u011fi Koronavir\u00fcs Tedbirleri konulu Ek Genelge ile Umuma A\u00e7\u0131k \u0130stirahat ve E\u011flence Yerleri olarak faaliyet y\u00fcr\u00fcten bir\u00e7ok i\u015fletmenin (g\u00f6steri merkezleri, konser salonlar\u0131, sinemalar, kafeler, \u00e7ocuk oyun alanlar\u0131, spor merkezleri) 16 Mart 2020 saat 24:00 itibariyle faaliyetlerinin ge\u00e7ici bir s\u00fcreyle durdurulaca\u011f\u0131 y\u00f6n\u00fcnde karar al\u0131nd\u0131. Ayn\u0131 zamanda bir\u00e7ok i\u015fletme kendi takdirlerinde olarak faaliyetlerine ara verdiklerini ya da uzaktan \u00e7al\u0131\u015fma karar\u0131 ald\u0131klar\u0131n\u0131; bir\u00e7ok perakendeci de ma\u011fazalar\u0131n\u0131 bir s\u00fcreli\u011fine kapatma karar\u0131 ald\u0131klar\u0131n\u0131 a\u00e7\u0131klad\u0131. Baz\u0131 al\u0131\u015fveri\u015f merkezleri Al\u0131\u015fveri\u015f Merkezleri ve Yat\u0131r\u0131mc\u0131lar\u0131 Derne\u011fi\u2019nin tavsiyesi \u00e7er\u00e7evesinde kapand\u0131.\u00a0Benzer \u015fekilde, T\u00fcrkiye Al\u0131\u015fveri\u015f Merkezleri ve Perakendeciler Federasyonu (TAMPF) COVID-19 salg\u0131n\u0131yla m\u00fccadele kapsam\u0131nda, TAMPF b\u00fcnyesindeki al\u0131\u015fveri\u015f merkezlerinin, perakendicelerin kapal\u0131 kald\u0131\u011f\u0131 d\u00f6nemde kira faturas\u0131 d\u00fczenlenmeyece\u011fini bildirmi\u015ftir.<\/p>\n<p>Gelir \u0130daresi Ba\u015fkanl\u0131\u011f\u0131 da resmi internet sayfas\u0131 \u00fczerinden COVID-19 salg\u0131n\u0131ndan do\u011frudan etkilenen m\u00fckelleflerin Nisan, May\u0131s ve Haziran aylar\u0131nda \u00f6demeleri gereken muhtasar ve katma de\u011fer vergilerinin \u00f6demelerinin alt\u0131 ay ertelenmesine y\u00f6nelik olarak gerekli \u00e7al\u0131\u015fmalar\u0131n yap\u0131ld\u0131\u011f\u0131 belirtti ve etkilenen m\u00fckellefler aras\u0131na al\u0131\u015fveri\u015f merkezleri ve al\u0131\u015fveri\u015f merkezinde faaliyette bulunan perakendecileri de dahil etti.<\/p>\n<p>Kiralad\u0131klar\u0131 i\u015fyerlerinde faaliyetlerini ger\u00e7ekle\u015ftiren i\u015fletmelerin u\u011frad\u0131klar\u0131 bu kesintilerin i\u015fletme (kirac\u0131) ile mal sahipleri aras\u0131ndaki kira ili\u015fkisini nas\u0131l etkileyece\u011fine ve bu etkilerin her iki taraf i\u00e7in de asgari \u00f6l\u00e7\u00fcde tutulmas\u0131 i\u00e7in hangi ad\u0131mlar\u0131n at\u0131labilece\u011fine y\u00f6nelik olas\u0131 hukuki ve pratik g\u00f6r\u00fc\u015flere a\u015fa\u011f\u0131da yer vermekteyiz.<\/p>\n<p><strong>1. H\u00fck\u00fcmetin ald\u0131\u011f\u0131 \u00f6nlemler \u00e7er\u00e7evesinde i\u015fletmenin tamamen kapanmas\u0131 halinde kirac\u0131lar\u0131n kira \u00f6deme y\u00fck\u00fcml\u00fcl\u00fckleri devam eder mi?<\/strong><\/p>\n<p>H\u00fck\u00fcmetin COVID-19 salg\u0131n\u0131na kar\u015f\u0131 ald\u0131\u011f\u0131 \u00f6nlemler \u00e7er\u00e7evesinde kirac\u0131 konumundaki i\u015fletmelerin tamamen kapat\u0131lmas\u0131, kirac\u0131lar a\u00e7\u0131s\u0131ndan beklenmeyen hal te\u015fkil edecektir. Bu nedenle kirac\u0131lar, bu beklenmeyen hal ve m\u00fccbir sebep sona erene kadar kira bedelinin \u00f6denmesi borcunun ask\u0131ya al\u0131nmas\u0131n\u0131, di\u011fer bir ifadeyle kira bedeli i\u015fletilmemesini kiraya verenden talep edebileceklerdir. S\u00f6z konusu salg\u0131n\u0131n uzamas\u0131 ve \u00f6nlemlerin devam\u0131 varsay\u0131m\u0131nda, kiraya veren bak\u0131m\u0131ndan da kiraya verilen yerin amaca uygun kullan\u0131lmas\u0131n\u0131n hukuken ve -belki de fiilen- m\u00fcmk\u00fcn olmamas\u0131ndan ve bu kira tahsil edilememe durumunun kiraya veren a\u00e7\u0131s\u0131ndan katlan\u0131lamaz hale gelmesinden hareketle hukuki taleplerde bulunma imkan\u0131 s\u00f6z konusu olabilir.<\/p>\n<p><strong>2. H\u00fck\u00fcmetin ald\u0131\u011f\u0131 \u00f6nlemler \u00e7er\u00e7evesinde, al\u0131\u015fveri\u015f merkezlerinin veya i\u015f merkezlerinin tamamen kapanmas\u0131 veya al\u0131\u015fveri\u015f merkezindeki baz\u0131 i\u015fletmelerin kapanmas\u0131 halinde kirac\u0131lar\u0131n ortak gider \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc devam eder mi?<\/strong><\/p>\n<p>Al\u0131\u015fveri\u015f merkezleri veya i\u015f merkezleri gibi yap\u0131lar\u0131n tamamen kapand\u0131\u011f\u0131 d\u00f6nemlerde dahi al\u0131\u015fveri\u015f merkezinde bulunan ma\u011fazalar\u0131n veya i\u015f merkezlerinde bulunan ofislerin g\u00fcvenli\u011fi, al\u0131\u015fveri\u015f merkezinin devaml\u0131l\u0131\u011f\u0131 ve i\u015fletilmeye haz\u0131r \u015fekilde bulundurulmas\u0131 i\u00e7in g\u00fcvenlik, temizlik, teknik destek gibi hizmetlerin s\u00fcrd\u00fcr\u00fclmesi gerekmektedir.<\/p>\n<p>S\u00f6z konusu bu hizmetler, al\u0131\u015fveri\u015f merkezindeki veya i\u015f merkezlerindeki kirac\u0131lara kar\u015f\u0131 y\u00fck\u00fcml\u00fcl\u00fcklerin yerine getirilmesi amac\u0131yla sa\u011fland\u0131\u011f\u0131ndan, kiraya verenin (veya al\u0131\u015fveri\u015f merkezi\/i\u015f merkezi y\u00f6netiminin) ortak giderleri, al\u0131nan \u00f6nlemler sebebiyle i\u015fletmesi kapanan kirac\u0131lardan da talep etmesi s\u00f6z konusu olabilir.<\/p>\n<p>Ancak, ileride ortaya \u00e7\u0131kabilecek uyu\u015fmazl\u0131klar\u0131n \u00f6n\u00fcne ge\u00e7ilebilmesi ad\u0131na, al\u0131\u015fveri\u015f merkezi ve i\u015f merkezi y\u00f6netiminin de, h\u00fck\u00fcmetin COVID-19 salg\u0131n\u0131na kar\u015f\u0131 ald\u0131\u011f\u0131 \u00f6nlemleri, a\u00e7\u0131k ma\u011faza\/ofis say\u0131s\u0131n\u0131, al\u0131\u015fveri\u015f merkezinin veya i\u015f merkezinin a\u00e7\u0131k kald\u0131\u011f\u0131 zaman dilimini ve m\u00fc\u015fteri yo\u011funlu\u011funu dikkate alarak, ortak giderlere konu hizmetlerin \u00fccretlendirmesini makul \u00f6l\u00e7\u00fcde tutmas\u0131 ve m\u00fcmk\u00fcnse \u00e7al\u0131\u015fanlar\u0131n vardiyalar\u0131n\u0131 yeni ihtiyaca g\u00f6re d\u00fczenlemesi faydal\u0131 olacakt\u0131r.<\/p>\n<p><strong>3. H\u00fck\u00fcmetin ald\u0131\u011f\u0131 \u00f6nlemler \u00e7er\u00e7evesinde i\u015fletmelerin, al\u0131\u015fveri\u015f merkezlerinin veya i\u015f merkezlerinin \u00e7al\u0131\u015fma saatlerine k\u0131s\u0131tlama getirilmesi halinde kirac\u0131lar kira bedelinde indirim talep edebilir mi?<\/strong><\/p>\n<p>H\u00fck\u00fcmetin COVID-19 salg\u0131n\u0131na kar\u015f\u0131 ald\u0131\u011f\u0131 \u00f6nlemler \u00e7er\u00e7evesinde baz\u0131 i\u015fletmelerin \u00e7al\u0131\u015fma saatlerine k\u0131s\u0131tlama getirilmesi durumu da s\u00f6z konusu i\u015fletmeler i\u00e7in beklenmeyen hal te\u015fkil etmektedir. \u0130\u015fletmeler her ne kadar a\u00e7\u0131k kalmaya devam edecek olsa da, i\u015fletmelerin a\u00e7\u0131k kald\u0131\u011f\u0131 saatlerin d\u00fc\u015f\u00fcr\u00fclmesi de m\u00fc\u015fteri say\u0131s\u0131nda \u00f6nemli \u00f6l\u00e7\u00fcde azalmaya sebebiyet verebilir. Bu nedenle, kirac\u0131lar\u0131n kiraya verenden uyarlama talep edebilmesi m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<p><strong>4. Kirac\u0131lar\u0131n tedarik zincirindeki aksamalar veya \u00e7al\u0131\u015fanlar\u0131n i\u015fe gelememesi gibi kirac\u0131 ile ilgili sebeplerden dolay\u0131 kirac\u0131lar kira bedelinde indirim talep edebilir mi?<\/strong><\/p>\n<p>Her ne kadar tedarik zincirindeki aksamalar veya \u00e7al\u0131\u015fanlar\u0131n i\u015fe gelememesi gibi kirac\u0131 ile ilgili sebeplerin kirac\u0131ya indirim talep hakk\u0131 tan\u0131mayaca\u011f\u0131 d\u00fc\u015f\u00fcn\u00fclse de bu gibi durumlar beklenmeyen hal olan COVID-19 salg\u0131n\u0131n\u0131n birer sonucu niteli\u011finde oldu\u011fu de\u011ferlendirilebilir. Dolay\u0131s\u0131yla bu ve benzeri durumlar dahi kirac\u0131n\u0131n kira s\u00f6zle\u015fmesinin uyarlanmas\u0131n\u0131 talep edebilece\u011fi y\u00f6n\u00fcnde yorumlanabilecektir.<\/p>\n<p><strong>6. Kirac\u0131lar, m\u00fc\u015fteri say\u0131lar\u0131ndaki azalma sebebiyle kira bedelinde indirim talep edebilir mi?<\/strong><\/p>\n<p>Kirac\u0131lar, COVID-19 salg\u0131n\u0131 sebebiyle m\u00fc\u015fteri say\u0131s\u0131nda azalma meydana gelmesi ve bu durumun s\u00fcreklilik arz etmesi halinde, kira s\u00f6zle\u015fmelerinin uyarlanmas\u0131n\u0131 talep edebileceklerdir.<\/p>\n<p><strong>7.
