Kanun uyar\u0131nca Tapu Kanunu, \u0130mar Kanunu, Belediye Kanunu ve T\u00fcrk Medeni Kanun dahil olmak pek \u00e7ok kanunda de\u011fi\u015fiklik yap\u0131ld\u0131.<\/p>\n<p><strong>De\u011fi\u015fiklikler Neler Getiriyor?<\/strong><\/p>\n<p><em><u>Tapu Kanunu&#8217;nda Yap\u0131lan \u00d6nemli De\u011fi\u015fiklikler<\/u><\/em><\/p>\n<ul>\n<li>Yeni d\u00fczenleme uyar\u0131nca ta\u015f\u0131nmaz m\u00fclkiyetinin devrini ama\u00e7layan s\u00f6zle\u015fmelerde, taraflar\u0131n farkl\u0131 tapu m\u00fcd\u00fcrl\u00fckleri veya yurt d\u0131\u015f\u0131 te\u015fkilat\u0131nda bulunmalar\u0131 h\u00e2linde, taraf iradeleri resm\u00ee g\u00f6revliler taraf\u0131ndan ayr\u0131 ayr\u0131 al\u0131narak s\u00f6zle\u015fme tamamlanabilecek. \u0130lgili d\u00fczenleme 1 Ocak 2020 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe girecek.<\/li>\n<li>Tapu Kanunu&#8217;na getirilen ek madde uyar\u0131nca kadastro tespiti veya tapu sicilinde ger\u00e7ekle\u015ftirilen hatalardan olumsuz etkilenen hisselerin maliklerine, ayni ve \u015fahsi hak lehtarlar\u0131na, hatan\u0131n nedenleri ve d\u00fczeltme sonras\u0131 olu\u015facak hisse durumunu g\u00f6steren tebligat yap\u0131lacak. \u0130lgililerin tebli\u011f tarihinden itibaren 30 g\u00fcn i\u00e7inde muvafakat vermesi halinde d\u00fczeltme i\u015flemi yap\u0131lacak. Muvafakatin 30 g\u00fcn i\u00e7inde verilmemesi halinde hata tapu m\u00fcd\u00fcrl\u00fc\u011f\u00fcnce re&#8217;sen d\u00fczeltilecek ve ilgililere ihtar edilecek. \u0130lgililer d\u00fczeltme i\u015flemine kar\u015f\u0131 tebli\u011f tarihinden itibaren 60 g\u00fcn i\u00e7inde asliye hukuk mahkemesinde dava a\u00e7abilecek.<\/li>\n<li>Tapu memurlar\u0131 taraf\u0131ndan resmi senetlere taraflar\u0131n veya mal sahibinin foto\u011fraflar\u0131n\u0131n yap\u0131\u015ft\u0131r\u0131lmas\u0131na ili\u015fkin d\u00fczenleme kald\u0131r\u0131ld\u0131.<\/li>\n<\/ul>\n<p><em><u>Kat M\u00fclkiyeti Kanunu&#8217;nda Yap\u0131lan \u00d6nemli De\u011fi\u015fiklikler<\/u><\/em><\/p>\n<ul>\n<li>Kat m\u00fclkiyetine tabi yap\u0131lar\u0131n hatal\u0131 blok numaralar\u0131n\u0131n d\u00fczeltilmesi i\u00e7in kat maliklerinin salt \u00e7o\u011funlu\u011fuyla al\u0131nm\u0131\u015f karar\u0131n ve ilgili teknik raporun, hatal\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin d\u00fczeltilmesi i\u00e7in ise yaln\u0131zca ilgili teknik raporun sunulmas\u0131 gerekecek.<\/li>\n<\/ul>\n<p><em><u>\u0130mar Kanunu&#8217;nda Yap\u0131lan \u00d6nemli De\u011fi\u015fiklikler<\/u><\/em><\/p>\n<p>&#8211; Tar\u0131m Arazileri<\/p>\n<ul>\n<li>Tar\u0131m arazilerinin ilgili mevzuatta \u00f6ng\u00f6r\u00fclen izinler al\u0131nmaks\u0131z\u0131n tar\u0131msal ama\u00e7 d\u0131\u015f\u0131nda kullan\u0131lmak \u00fczere planlanmas\u0131n\u0131 yasaklayan h\u00fck\u00fcm, bu arazilerin kullan\u0131m\u0131n\u0131 ve yerle\u015fik alan olarak tespit edilmesini de kapsayacak \u015fekilde geni\u015fletildi.<\/li>\n<\/ul>\n<p>&#8211; D\u00fczenleme Ortakl\u0131k Paylar\u0131<\/p>\n<ul>\n<li>D\u00fczenleme ortakl\u0131k paylar\u0131n\u0131n kapsam\u0131, e\u011fitim tesis alanlar\u0131 ve sa\u011fl\u0131k tesis alanlar\u0131 gibi genel kamu hizmetlerine ayr\u0131lan yerleri i\u00e7erecek \u015fekilde geni\u015fletildi ve kamu ortakl\u0131k paylar\u0131 kald\u0131r\u0131ld\u0131. D\u00fczenlemeye tabi tutulan arazi ve arsalardan kesilecek d\u00fczenleme ortakl\u0131k paylar\u0131 i\u00e7in \u00fcst s\u0131n\u0131r y\u00fczde 40&#8217;dan y\u00fczde 45&#8217;e \u00e7\u0131kar\u0131ld\u0131. Bu do\u011frultuda d\u00fczenleme ortakl\u0131k pay\u0131, ilgili arsa veya arazinin d\u00fczenlemeden \u00f6nceki y\u00fcz\u00f6l\u00e7\u00fcmlerinin y\u00fczde 45&#8217;ini ge\u00e7emeyecek.<\/li>\n<li>Herhangi bir parselden bir defadan fazla d\u00fczenleme ortakl\u0131k pay\u0131 al\u0131namayacak. Ancak, imar plan\u0131 karar\u0131 ile yap\u0131la\u015fma ko\u015fulunda ve n\u00fcfusta art\u0131\u015f olmas\u0131 halinde, art\u0131\u015f olan parselden ilk uygulamada kesilen d\u00fczenleme ortakl\u0131k pay\u0131 oran\u0131n\u0131 y\u00fczde 45&#8217;e tamamlamak \u00fczere ilave ortakl\u0131k pay\u0131 kesintisi yap\u0131labilecek.<\/li>\n<li>Mevcut yap\u0131lar nedeniyle parsellerden d\u00fczenleme ortakl\u0131k pay\u0131 al\u0131namad\u0131\u011f\u0131 hallerde bu pay\u0131n miktar\u0131, d\u00fczenlemenin ger\u00e7ekle\u015ftirilebilmesi i\u00e7in yap\u0131lacak kamula\u015ft\u0131rmada kullan\u0131lmak \u00fczere bedele d\u00f6n\u00fc\u015ft\u00fcr\u00fclebilecek.<\/li>\n<li>\u0130lgili idare veya yetkili kurumca onaylanm\u0131\u015f ancak tescil i\u015flemi tamamlanmam\u0131\u015f parsellerin halihaz\u0131rda hesaplanm\u0131\u015f d\u00fczenleme ortakl\u0131k pay\u0131 ve kamu ortakl\u0131k pay\u0131 kesintilerine g\u00f6re y\u00fcr\u00fct\u00fclen i\u015flemlere 10 Temmuz 2021 y\u0131l\u0131na kadar devam edilecek.<\/li>\n<\/ul>\n<p>&#8211; Otoparklar<\/p>\n<ul>\n<li>Yap\u0131la\u015fmam\u0131\u015f parseller, parsel maliklerinin muvafakati ile ara\u00e7 giri\u015f \u00e7\u0131k\u0131\u015flar\u0131n trafi\u011fi aksatmamas\u0131 ve ilgili idareden izin al\u0131nmas\u0131 kayd\u0131yla a\u00e7\u0131k otopark olarak i\u015fletilebilecek.<\/li>\n<\/ul>\n<p>&#8211; Metruk Yap\u0131lar<\/p>\n<ul>\n<li>Y\u0131k\u0131lacak derecede tehlikeli yap\u0131lara ili\u015fkin yeni d\u00fczenleme getirildi. Yeni h\u00fck\u00fcm uyar\u0131nca genel g\u00fcvenlik ve asayi\u015f bak\u0131m\u0131ndan tehlike arz etti\u011fi tespit edilen metruk yap\u0131lar ile y\u0131k\u0131lacak derecede tehlikeli yap\u0131lar i\u00e7in yap\u0131 sahiplerine belediye veya valilik\u00e7e 3 g\u00fcn i\u00e7inde tebligat yap\u0131lacak. Tebligat yap\u0131lamamas\u0131 halinde durum, ilgili idarenin internet sitesinde 30 g\u00fcn s\u00fcre ile ilan edilecek. Tebligat veya ilan\u0131 m\u00fcteakip 30 g\u00fcn\u00fc ge\u00e7memek \u00fczere ilgili idarece verilen s\u00fcre i\u00e7inde tehlikeli durumun ortadan kald\u0131r\u0131lmamas\u0131 halinde i\u015flemler ilgili idare taraf\u0131ndan yap\u0131lacak ve masraflar, y\u00fczde 20 fazlas\u0131 ile yap\u0131 sahibinden tahsil edilecek.<\/li>\n<\/ul>\n<p>&#8211; \u0130mar Uygulama Hatalar\u0131 ve Cumhurba\u015fkan\u0131&#8217;n\u0131n Yetkisi<\/p>\n<ul>\n<li>Alan, s\u0131n\u0131r, hisse d\u00fczeltimi yap\u0131lamamas\u0131 nedeniyle meydana gelen imar uygulama hatalar\u0131n\u0131n d\u00fczeltilemedi\u011fi, konu \u00e7e\u015fitlili\u011fi ve taraf fazlal\u0131\u011f\u0131 gibi sebeplerden \u00f6t\u00fcr\u00fc dava yolu ile \u00e7\u00f6z\u00fcm\u00fc m\u00fcmk\u00fcn olmayan ta\u015f\u0131nmazlar i\u00e7in s\u0131n\u0131r ve koordinatlar Cumhurba\u015fkan\u0131 taraf\u0131ndan belirlenecek.<\/li>\n<\/ul>\n<p>&#8211; Yap\u0131 Kay\u0131t Belgesine Konu Yap\u0131lar ve Ecrimisil<\/p>\n<ul>\n<li>Ruhsats\u0131z veya ruhsat ve eklerine ayk\u0131r\u0131 yap\u0131lar i\u00e7in verilen yap\u0131 kay\u0131t belgesine konu ta\u015f\u0131nmazlar i\u00e7in yeni h\u00fck\u00fcm getirildi. Bu yap\u0131lar\u0131n \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131&#8217;na (&#8220;<strong>Bakanl\u0131k<\/strong>&#8220;) tahsis edilmesi ve sat\u0131\u015fa konu olmas\u0131 halinde, s\u00f6z konusu ta\u015f\u0131nmaz i\u00e7in yap\u0131 kay\u0131t belgesi tarihi ile sat\u0131\u015f tarihi aras\u0131ndaki d\u00f6nem i\u00e7in ecrimisil al\u0131nmayacak. Bu yap\u0131lar i\u00e7in tapu tahsis belgesi al\u0131nm\u0131\u015f olmas\u0131 ve ilgili arsa bedellerinin \u00f6denmi\u015f olmas\u0131 halinde sat\u0131\u015f bedeli al\u0131nmayacak.<\/li>\n<\/ul>\n<p><em>T\u00fcrk Medeni Kanunu&#8217;nda Yap\u0131lan \u00d6nemli De\u011fi\u015fiklikler<\/em><\/p>\n<ul>\n<li>S\u00fcreli ipoteklerde, s\u00fcrenin bitiminden itibaren 30 g\u00fcn \u00f6nce \u0130cra ve \u0130flas Kanunu&#8217;nun 150\/c maddesinde \u00f6ng\u00f6r\u00fclen \u015ferhin konulmamas\u0131 halinde ipotek, malikin talebiyle tapu m\u00fcd\u00fcrl\u00fc\u011f\u00fcnce terkin edilebilecektir. D\u00fczenleme 1 Ocak 2020 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe girecektir. 1 Ocak 2020 tarihinden \u00f6nce s\u00fcresi dolmu\u015f olmas\u0131na ra\u011fmen terkin edilmeyen s\u00fcreli ipotekler i\u00e7in ise s\u00f6z konusu 30 g\u00fcnl\u00fck s\u00fcre Tapu Kanunu&#8217;na getirilen d\u00fczenleme uyar\u0131nca 1 Ocak 2020 tarihinden itibaren ba\u015flayacakt\u0131r.<\/li>\n<\/ul>\n<p><em>Belediye Kanunu&#8217;nda Yap\u0131lan \u00d6nemli De\u011fi\u015fiklikler<\/em><\/p>\n<ul>\n<li>E\u011fitim ve sa\u011fl\u0131k alanlar\u0131 hari\u00e7 almak \u00fczere, kentsel d\u00f6n\u00fc\u015f\u00fcm ve geli\u015fim alanlar\u0131 i\u00e7inde yer alan ve belediyelere devredilen kamuya ait ta\u015f\u0131nmazlar i\u00e7in kentsel d\u00f6n\u00fc\u015f\u00fcm ve geli\u015fim alan\u0131 karar\u0131n\u0131n al\u0131nd\u0131\u011f\u0131 tarihten itibaren\u00a0ecrimisil\u00a0al\u0131nmayacak, tahakkuk ettirilen\u00a0ecrimisiller\u00a0terkin edilecek, tahsil edilenler ise iade edilecek.<\/li>\n<\/ul>\n<p><em>Orman K\u00f6yl\u00fclerinin Kalk\u0131nmalar\u0131n\u0131n Desteklenmesi ve Hazine Ad\u0131na Orman S\u0131n\u0131rlar\u0131 D\u0131\u015f\u0131na \u00c7\u0131kar\u0131lan Yerlerin De\u011ferlendirilmesi ile Hazineye Ait Tar\u0131m Arazilerinin Sat\u0131\u015f\u0131 Hakk\u0131nda Kanun&#8217;da Yap\u0131lan \u00d6nemli De\u011fi\u015fiklikler<\/em><\/p>\n<ul>\n<li>2\/B alanlar\u0131nda bulunan ta\u015f\u0131nmazlar ile Hazineye ait tar\u0131m arazilerinin bu kanun kapsam\u0131nda sat\u0131\u015f\u0131na ili\u015fkin olarak; s\u00fcresi i\u00e7inde ba\u015fvuru yapmayanlar\u0131n, kendilerine yap\u0131lan tebligatta belirtilen bedeli s\u00fcresi i\u00e7erisinde \u00f6demeyenlerin, taksitli sat\u0131\u015flarda, s\u00f6zle\u015fmesinde belirtilen taksitlerden ikiden fazlas\u0131n\u0131 vadesinde \u00f6demeyenlerin, \u00f6deme ve ba\u015fvuru s\u00fcreleri 16\/12\/2019 tarihine kadar uzat\u0131lm\u0131\u015ft\u0131r.<\/li>\n<li>Fakat, tebligatta belirtilen bedel ile ilgili olan de\u011fi\u015fiklikten yararlan\u0131labilmesi i\u00e7in sat\u0131\u015f bedelinin y\u00fczde ellisinin 16\/12\/2019 tarihine kadar \u00f6denmesi gerekir.<\/li>\n<\/ul>\n<p><em>Afet Riski Alt\u0131ndaki Alanlar\u0131n D\u00f6n\u00fc\u015ft\u00fcr\u00fclmesi Hakk\u0131nda Kanun&#8217;da Yap\u0131lan \u00d6nemli De\u011fi\u015fiklikler<\/em><\/p>\n<ul>\n<li>Kentsel d\u00f6n\u00fc\u015f\u00fcm uygulamalar\u0131nda m\u00fcteahhide devredilen ta\u015f\u0131nmazlar i\u00e7in, ta\u015f\u0131nmaz malikleri ad\u0131na kat irtifak\u0131 kuruluncaya kadar, o yap\u0131m i\u015fine ait malzeme ve i\u015f\u00e7ilik alacaklar\u0131 hari\u00e7 olmak \u00fczere, m\u00fcteahhidin \u00fc\u00e7\u00fcnc\u00fc ki\u015filere olan bor\u00e7lar\u0131ndan dolay\u0131 bu ta\u015f\u0131nmazlar hakk\u0131nda haciz ve tedbir uygulanamayacak. Ancak yap\u0131m i\u015fine ba\u015flanmas\u0131ndan itibaren alt\u0131 ay i\u00e7erisinde kat irtifak\u0131n\u0131n kurulmamas\u0131 durumunda, bu ta\u015f\u0131nmazlar hakk\u0131nda haciz ve tedbir uygulanmas\u0131 m\u00fcmk\u00fcn olacak.<\/li>\n<li>Ek olarak, ta\u015f\u0131nmaz malikleri ile yap\u0131lan s\u00f6zle\u015fmeler kapsam\u0131nda yap\u0131m i\u015fini \u00fcstlenen m\u00fcteahhitlerin pay\u0131na d\u00fc\u015fen ba\u011f\u0131ms\u0131z birimlerin sat\u0131\u015f\u0131, in\u015faat\u0131n ilerleme seviyesine g\u00f6re ve ilgili belediyenin iznine istinaden yap\u0131labilecek. M\u00fcteahhit pay\u0131na d\u00fc\u015fen ba\u011f\u0131ms\u0131z birimlerin, in\u015faat\u0131n tamamlanma oran\u0131nda veya bu oran\u0131n \u00fcst\u00fcndeki bir oranda sat\u0131\u015f\u0131 i\u00e7in b\u00fct\u00fcn maliklerin muvafakati gerekecek.<\/li>\n<li>Ayr\u0131ca, kentsel d\u00f6n\u00fc\u015f\u00fcm kapsam\u0131ndaki alan ve parsele ili\u015fkin olarak m\u00fcteahhitten kaynaklanan sebeplerle, bir y\u0131l i\u00e7inde yeni yap\u0131n\u0131n yap\u0131m i\u015fine ba\u015flanmam\u0131\u015f veya yap\u0131m i\u015fi belirli bir seviyede durdurulmu\u015f ve en az alt\u0131 ayd\u0131r faaliyete devam edilmiyor ise, yap\u0131lan s\u00f6zle\u015fmelerin feshi i\u00e7in hisseleri oran\u0131nda maliklerin en az \u00fc\u00e7te iki \u00e7o\u011funlu\u011fu ile karar al\u0131nabilecek ve bu karar ile Bakanl\u0131k&#8217;tan s\u00f6z konusu durumlar\u0131n tespiti talep edilebilecek. Belirtilen durumlar\u0131n tespit edilmesi halinde m\u00fcteahhide Bakanl\u0131k taraf\u0131ndan 30 g\u00fcn verilecek. M\u00fcteahhidin 30 g\u00fcn i\u00e7inde i\u015fe ba\u015flamamas\u0131 halinde m\u00fcteahhit ile hak sahipleri aras\u0131ndaki s\u00f6zle\u015fmeler ilgililerin muvafakati aranmaks\u0131z\u0131n resen feshedilmi\u015f say\u0131lacak.<\/li>\n<li>Fesih sonras\u0131nda, ta\u015f\u0131nmazlar\u0131n siciline \u015ferh edilmi\u015f olan s\u00f6zle\u015fmeler maliklerin veya Bakanl\u0131\u011f\u0131n talebi \u00fczerine terkin edilecek. Fesih tarihine kadar yap\u0131lm\u0131\u015f olan i\u015fler, devrolunan hisseler, yap\u0131lan \u00f6demeler ve di\u011fer hususlarda genel hukuk h\u00fck\u00fcmleri uygulanacak. Fesih tarihine kadar m\u00fcteahhit taraf\u0131ndan hak sahiplerine yap\u0131lan kira yard\u0131m\u0131 \u00f6demeleri hak sahiplerinden geri talep edilemeyecek.<\/li>\n<li>Y\u0131k\u0131lacak derecede riskli olan yap\u0131lar\u0131n bulundu\u011fu alanlar ile a\u011f\u0131r hasar g\u00f6ren veya a\u011f\u0131r hasar g\u00f6rme riski bulunan yap\u0131lar\u0131n bulundu\u011fu alanlarda d\u00f6n\u00fc\u015f\u00fcm uygulamalar\u0131 maliklerin ve ilgililerin muvafakati aranmaks\u0131z\u0131n Bakanl\u0131k\u00e7a resen yap\u0131labilecek veya yapt\u0131r\u0131labilecek. Bu yap\u0131lara ili\u015fkin ilgili idareler nezdinde yap\u0131lacak t\u00fcm tapu ve kadastro i\u015flemleri, y\u0131k\u0131m ve yap\u0131ma ili\u015fkin her t\u00fcrl\u00fc izin ve ruhsat i\u015f ve i\u015flemleri dahil olmak \u00fczere maliklerin ve ilgililerin muvafakati aranmaks\u0131z\u0131n Bakanl\u0131\u011f\u0131n talebine istinaden yap\u0131lacak.<\/li>\n<\/ul>\n<p><strong>Sonu\u00e7<\/strong><\/p>\n<p>Kanun de\u011fi\u015fiklikleri kapsam\u0131nda yurtd\u0131\u015f\u0131ndaki vatanda\u015flar\u0131n tapu i\u015flemleri, metruk binalar\u0131n y\u0131k\u0131lmas\u0131, kentsel d\u00f6n\u00fc\u015f\u00fcm, tar\u0131m arazilerinin kullan\u0131m\u0131 ve kamu ortakl\u0131k paylar\u0131n\u0131n kald\u0131r\u0131lmas\u0131 gibi konularda yeni d\u00fczenlemeler getirildi. Bu do\u011frultuda t\u00fcm ilgili ki\u015fi ve kurulu\u015flar, s\u00f6z konusu de\u011fi\u015fiklikleri dikkatle incelemeli, \u00f6ng\u00f6r\u00fclen usul ve esaslara uygun hareket
